Welcome to Atlas. These Terms of Service ("Terms") govern your use of the Atlas macOS app and the atlas-website.vercel.app website (collectively, the "Service"), operated by OfffWhite Design ("we", "us", or "our"). By downloading, installing, or using Atlas, you agree to these Terms.

1. Using Atlas

You may use Atlas for any lawful personal or commercial purpose. You agree not to:

• Use the Service in any way that violates applicable law.
• Reverse-engineer, decompile, or attempt to extract the source code of Atlas except as permitted by law.
• Redistribute, resell, or sublicense Atlas without our written permission.
• Use Atlas to create, store, or distribute harmful, infringing, or illegal content.

2. Your content

Anything you create in Atlas — notes, sketches, projects, canvases — is and remains yours. We claim no ownership over your content. Because your data is stored locally on your device, you are also responsible for backing it up. We recommend enabling Time Machine or your preferred backup solution.

3. Atlas Pro subscription

• Billing — Atlas Pro is a paid subscription billed monthly or annually. Prices are listed on our website and may change with notice.
• Renewal — Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date.
• Cancellation— You can cancel anytime. You'll keep Pro access until the end of your current billing period.
• Refunds— We offer a full refund within 7 days of your first Pro purchase if it's not the right fit. Contact us to request one.

4. Third-party services

Atlas integrates with optional third-party services such as AI providers (OpenAI, Anthropic, etc.). Your use of these services is governed by their own terms and privacy policies. You are responsible for any costs or obligations incurred with third-party providers when using your own API keys.

5. Intellectual property

Atlas, the Atlas name, logo, design, and all original content on our website are the property of OfffWhite Design and are protected by copyright, trademark, and other laws. These Terms do not grant you any rights to our branding or intellectual property beyond using the Service as intended.

6. Disclaimer of warranties

Atlas is provided "as is" and "as available" without warranties of any kind, express or implied. We do our best to keep Atlas reliable, fast, and bug-free — but we can't guarantee the Service will always be available, error-free, or meet your specific needs.

7. Limitation of liability

To the fullest extent permitted by law, OfffWhite Design will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising out of your use of or inability to use Atlas. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months preceding the claim.

8. Termination

You can stop using Atlas at any time. We may suspend or terminate your access to the Service if you violate these Terms. On termination, provisions that should survive (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the date at the top of this page. Continued use of Atlas after changes means you accept the updated Terms.
